1. Introduction

This Privacy Policy explains how Talenode-Analytics Consultancy Private Limited (“Talenode”, “we”, “our” or “us”) collects, uses and protects personal data in connection with our website at www.talenode.ai (the “Website”) and our HR data management platform (the “Platform”). Talenode is incorporated under Indian law and has its registered office at Stirring Minds, 2-A/3, Turkman Gate, Asaf Ali Rd, Darya Ganj, New Delhi, Central Delhi-110002, India.

Talenode operates in two roles: as a Data Controller for personal data collected through the Website and from prospective clients; and as a Data Processor (or, where our client is itself a Processor acting on behalf of its own customer, as a Sub-Processor) when processing HR workforce data on behalf of our business clients (who are the Data Controllers for their employees’ data). Client employees whose HR data is processed through the Platform should contact their employer directly for information about how their data is handled.

2. What We Collect and How

Personal data collected in connection with the Website is limited to the following:

(a) Demo scheduling via Calendly. Our Book a Demo and Contact page uses a scheduling widget provided by Calendly LLC. When you request a demo, Calendly collects your name, work email address, company name and meeting preferences directly on its platform. Calendly processes this data on our behalf. Calendly’s privacy policy and DPA (incorporating EU SCCs and UK IDTA) are available at calendly.com.

(b) Cookies and website analytics. Our Website is built on the Wix platform. When you visit our Website, Wix may automatically collect your IP address, browser and device information, pages visited and session data through cookies and similar technologies. This data collection and the cookie consent banner on our Website are managed by Wix. You can control cookies through your browser settings or the cookie consent banner. Wix’s privacy policy is available at support.wix.com.

(c) Platform access. If you access the Platform as a representative of a client organisation, we collect your name, work email and login credentials to the extent necessary to provide you with Platform access.

3. Why We Use Your Data

We use personal data for the following purposes: responding to demo requests and sales enquiries (lawful basis: pre-contractual steps or consent); improving our Website and understanding visitor behaviour (legitimate interests); providing Platform access to client representatives (performance of contract); and complying with legal obligations.

We do not sell your personal data to any third party, and we do not use it for unsolicited marketing without your consent.

4. Data Sharing

We may share personal data with:

Service providers who assist us in delivering our Website, Platform and business operations, including Calendly (demo scheduling, US), Wix (website hosting, US/global), Amazon Web Services (cloud infrastructure, India and US), Microsoft (productivity and communications, global), and Storch Consultancy (outsourced billing and finance, India). All providers are bound by appropriate data protection obligations.
Professional advisers (lawyers, accountants, auditors) where necessary.
Legal or regulatory authorities where required by law or to protect our rights.
A successor entity in the event of a merger, acquisition or business transfer, subject to confidentiality obligations.

5. International Data Transfers

Talenode is established in India. If you are in the EU or UK, your personal data may be transferred to India for processing. Where we transfer data internationally, we ensure appropriate safeguards are in place. Demo scheduling data is transferred to Calendly in the US under Calendly’s standard DPA incorporating EU SCCs and the UK IDTA. Website data is processed by Wix under its own transfer mechanisms. Platform data is processed in India (AWS Mumbai region) with backups in India (AWS Hyderabad region), and may involve AI-assisted processing via AWS Bedrock in the US, governed by the AWS Data Processing Addendum incorporating SCCs.

6. Data Retention

We retain personal data only as long as necessary for the purpose for which it was collected, to comply with legal obligations, and to resolve disputes. Prospect and scheduling data is retained for the duration of our sales engagement and a reasonable period thereafter. Platform client data is retained for the duration of the client agreement and deleted or returned within ninety (90) days of termination. Website analytics data is retained in accordance with Wix’s policies.

7. Security

We implement appropriate technical and organisational measures to protect personal data, including ISO 27001:2022 certified information security management (Certificate No. 305025060612IS), encryption at rest and in transit, role-based access controls, multi-factor authentication and regular security assessments. No method of internet transmission is completely secure; if you suspect a security issue please contact us at privacy@talenode.ai.

8. Your Rights

Depending on your location, you may have rights to access, rectify, erase, restrict or port your personal data, to object to processing, and to withdraw consent at any time. You also have the right to lodge a complaint with your supervisory authority: the Information Commissioner’s Office (ICO) for UK residents (ico.org.uk); the relevant EU national data protection authority for EU residents; and the Data Protection Board of India for Indian residents.

9. Applicable Law

This Privacy Policy is designed to comply with the EU General Data Protection Regulation (EU GDPR), the UK GDPR and Data Protection Act 2018, and India’s Digital Personal Data Protection Act 2023 (DPDP Act).

10. General

Our Website may contain links to third-party websites; we are not responsible for their privacy practices. Our Platform and Website are not intended for individuals under 18 and we do not knowingly collect data from children. We may update this Privacy Policy from time to time; the “Last Updated” date at the top will reflect any changes. We encourage you to review this policy periodically.
